of entry to the 2010 World Vintage Rugby Carnival

Terms and conditions of entry to the 2010 World Vintage Rugby Carnival

1 The completion of the team entry form and payment of the entry fee confirms that (‘the Team’) accepts the terms and conditions of entry that follow. A copy of these conditions are also on the Carnival website www.vintagerugby.com.

2 All players must be at least 35 years of age or over on September 1, 2010.

3 Participants (‘the Players’) acknowledge that they are personally responsible for their own fitness and should injuries be sustained during the 2010 Carnival medical staff are authorized to provide whatever medical attention is required.

4 Players acknowledge that any costs incurred as a result of medical attention required during the 2010 Carnival will be their personal responsibility.

5 All Players must take out appropriate health insurance and evidence of this will be required to be shown prior to the commencement of each game during the 2010 Carnival.

6 The Players agree to abide by the rules and regulations established and promulgated by the organizers of the 2010 Carnival.

7 Entries for the 2010 Carnival will close on May 31, 2010.

8 The team entry fee is non refundable.

9 All entries will be subject to acceptance by the organizers of the 2010 Carnival, who reserve the right to decline any entry should they consider there is non-compliance with the “Terms and Conditions of Entry”. Any refund of ground package payments will only be made in accordance with the payment and refund rules that will be advised to all teams.

10 Players living further than 100km radius of Cape Town must take one of the 2010 Carnival accommodation packages. Teams originating from within this perimeter will be required to purchase a local package details of which will be advised as local team entries are received.

11 The Organizers of the 2010 Carnival act only as agent for the providers of 2010 Carnival ground packages and will not be liable for any injury, cost damage, expense, loss or delay which may be sustained or occasioned by reason of the negligence or default of any person or sub-contractor engaged to supply such services.

12 Unforeseen circumstances may necessitate the lengthening or shortening of the 2010 Carnival and in such case adjustments to the cost of the package will be on a pro-rata basis. No refund will be made for any unused portion of this package.

Waiver, Release and Indemnification:
1. In consideration of the Team’s entry in the 2010 World Vintage Carnival (the “Carnival”) the Team agrees to comply with the Carnival Terms and Conditions of Entry as supplied by the Carnival organisers detailed above and with all other rules, regulations and instructions associated with the Carnival as provided from time to time by the Carnival organisers or its directors.
2. The Team:
(a) Waives and releases the Carnival, its committee, its officers, directors, members,volunteers, host clubs, employees, agents, sponsors, the City of Cape Town, Wynberg Boys High School, the Vintage Sports Office, Sports and Leisure Marketing Limited and any and all of their executors, administrators, heirs, next of kin, successors and assigns (“the Released Parties”) from any and all claims the Team may have against them as a result of participating in the Carnival and any activities or events related to it, including, but not limited to, any costs, including lawyers fees, incurred as a result of any such claim, irrespective of that claim’svalidity; and
(b) Indemnifies the Released Parties from and against any and all liabilities including any claims, losses, liabilities, costs, damages, charges and expenses which such Released Parties may suffer or incur as a result of any claims or proceedings brought, or threatened to be brought, against them by the Team; and
(c) Releases and indemnifies the Released Parties from any and all liability that might result from any injury, accident, illness or death during the Carnival or any activity or event related to it.

3. The Team acknowledges that it has sole responsibility for its sporting equipment, goods and possessions during the Carnival and any activities or events related to it. No claim shall in any circumstances be made against the Released Parties in relation to the loss of, or damage to, any Team equipment, goods or other possessions.

4. The Team consents to any member of the Team who is in an accident, suffering an illness or otherwise injured during the course of the Carnival, at any event comprising part of the Carnival or any activity or event related to the Carnival receiving medical treatment from any person authorized by the Carnival to an extent that authorized person deems medically necessary and prudent.

5. The Carnival organizers may use the names of the Team, its individual members and their images in any broadcast, telecast, press statement or publication, so long as the purpose of such use is related solely to the Carnival and its organisation.

6. The Carnival organizers may provide details about the Team to other organizations directly associated with the organization of the 2010 Carnival. For the avoidance of doubt this includes the Carnival ground operator airline partner, merchandiser and photographer.

7. For the purposes of this document the Team shall include all members attending the 2010 Carnival, both playing and non-playing, their executors, administrators, heirs, next of kin, successors and assigns.
 
Prior to acceptance of an application to attend the 2010 World Vintage Rugby Carnival the above form will need to be completed. Participants can choose to seek independent legal advice. Individual players and visiting referees will also have to sign an indemnification and waiver before they can take the field. No indemnification – no play. It is the responsibility of a team organiser to make sure all participants they represent understand the rules and waiver and disclaimer.
